1. Scope This agreement is concluded electronically between the person using AFFAMAZON.COM and the party operating the platform. 2. Subject The subject of this agreement is to define the terms of membership, the conditions for benefiting from the services, and the rights and obligations of the parties. 3. Purpose Regarding account security and membership, the user accepts that: - The information provided during registration is accurate and up to date - The account is personal and cannot be transferred - The user is responsible for password security - Transactions made through the account may be deemed to belong to the user 4. Collection Method and Legal Basis The platform may provide digital content, training panels, AI tools, product ideas, and related digital services depending on the selected plan. 5. Transfer For paid plans, the user accepts that: - Some features are available only in paid plans - Plans may be time-limited or quota-limited - Access may be restricted when time or quota ends - The scope of service is limited to the details specified in the plan 6. Rights While using the platform, the user agrees to comply with the following rules: - Not to use the platform for unlawful purposes - Not to abuse the system - Not to perform actions that may damage the infrastructure - Not to attempt unauthorized access - Not to violate the rights of other users 7. Retention / Duration The platform design, software, texts, training structure, brand elements, and system components are protected under intellectual property law. 8. Responsibility / Contact The platform owner reserves the right to change the scope of service, prices, plan structure, content, and technical features. 9. Effectiveness If the user acts contrary to the agreement, the membership may be suspended, limited, or terminated. 10. Limitation of Liability The platform is a digital assistance/production tool. NO guarantee is given regarding income, sales, views, commercial success, or performance; results depend entirely on the user’s own usage, content quality, and market conditions. Purchased credits are a digital service and are deemed performed the moment they start being used to generate content/video, and are NON-REFUNDABLE; each generation incurs real server and API costs. 11. Evidential Nature The parties accept that system records, logs, database records, and electronic outputs may constitute evidence in disputes. 12. Acceptance The user is deemed to have read and accepted this agreement once membership is created. 13. Limitation of Liability and Disclaimer of Warranties The service is provided "as is" and "as available". The Platform gives no express or implied warranty of uninterrupted or error-free operation, fitness for a particular purpose, or any specific outcome (income, views, ranking, sales, followers). Under no circumstances shall the Platform be liable for indirect, incidental, special, or consequential damages (including loss of profit, data, reputation, business or opportunity). The Platform’s total liability is in all cases limited to the amount the user paid in the last one (1) month. 14. Third-Party Platforms and Risks The Platform depends on third-party services such as YouTube, Amazon, TikTok, payment providers, and various APIs/services. The following are NOT the Platform’s responsibility and do not constitute grounds for refund, discount, or compensation: - YouTube, Amazon, or other platforms suspending, closing, or demonetizing a user account, cancelling affiliate/partner membership, or removing content - Third-party APIs/services experiencing outages, applying quotas/limits, changing prices or policies, or discontinuing access - The user failing to obtain, maintain, or being terminated from the Amazon Associates Program, YouTube Partner Program, or similar memberships - The user failing to comply with third-party platforms’ terms of use, copyright, and advertising/affiliate disclosure rules The user accepts that all responsibility for the content produced, the accounts used, and the third-party programs relied upon rests with the user, and that the Platform is solely a production/automation tool. 15. Refunds, Chargebacks, and Payment Security Purchased credits and digital services are deemed performed once they start being used and are non-refundable (see the Distance Sales Agreement). Chargebacks and unjustified refund/dispute requests made after the service has been performed or credits used are deemed made in bad faith; in such cases the Platform reserves the right to suspend the account, halt remaining service, and pursue legal remedies for damages. All taxes and legal obligations arising are the user’s responsibility.
